State regulations prohibit CBRF’s from hiring staff under the age of 18. (DHS 83.16(2)) Although DQA has allowed facilities to request waiver of the restriction, its policy required a facility to seek a separate wavier for every minor it was considering for employment. The time, effort, and delay inherent in compliance with this policy made it impractical for CBRFs to consider or pursue employment of qualified staff under the age of 18. The policy not only impeded a facility’s ability to secure much needed staff, it created an inappropriate constraint on employment of qualified minors that have expressed and exhibited a desire to become caregivers.
